Agency Workers Regulations (NI)
The Agency Workers Regulations (Northern Ireland) came into effect on 5th December 2011. It was put in place to provide temporary agency workers the right to the same basic employment and working conditions as those directly recruited by the host business. There is a lead in period of 12 weeks before most of these rights come into effect.
Day 1 Entitlements
Without any lead in period all temporary agency workers are entitled to the following:
Facilities – access to general facilities available to staff in the organisation doing the same or similar role.
Vacancies – access to information of job vacancies available at the site of engagement.
Week 13 Entitlements
12 weeks after 1st October 2011 or 12 weeks after the commencement of an assignment (if after that), temporary agency workers will be entitled to the following:
Pay - same basic rate, overtime pay, shift allowance and in some cases bonus/commission as a directly hired employee in the host business undertaking the same or similar role.
Hours of work - same breaks and hours of work as a directly hired employee in the host business undertaking the same or similar role.
Annual Leave - same paid annual leave as a directly hired employee in the host business undertaking the same or similar role.
